Who is Responsible For Pool Maintenance?

Who takes care of what?

 

Generally, the tenant is responsible for everyday maintenance such as clearing leaves from the pool and may be responsible for regular maintenance. However, owners must have a pool safety certificate issued by a licensed pool safety inspector. A copy of the certificate as well as the maintenance of a pool should be included in the special terms of the tenancy agreement.

To break it down just a little – What the landlord is responsible for?

  • The landlord must ensure that the pool is fenced and gated to the standard required by the Queensland Building and Construction Commission and that trees, other vegetation or fixed facilities cannot be used by children to climb over the fence. The landlord must also ensure any damage to the pool fence or gate is fixed immediately.

  • The landlord is also responsible for structural repairs to the pool that are the result of age or poor manufacture/ installation. Pool pumps and chlorinators that require replacement due to age and normal wear and tear are also the responsibility of the landlord.

What the tenant is responsible for?

  • The tenant is responsible for everyday cleaning and maintenance, this includes cleaning filters, removing leaves and ensuring chemical levels are adequate to maintain a safe and clean pH level (unless it’s a clause in the lease that pool maintenance is included).  This generally means the tenant is responsible for purchasing and applying such chemicals unless otherwise stated on the tenancy agreement.

  • Ideally, the property manager/owner should provide instructions for any maintenance the tenant must carry out.
