Taking photos in a rental property

 

What can you photograph when you have tenants in your rental?

Tenants have rights and all agents and owners need to be aware before attempting to take photos within a rental property.

 

If you are considering leasing or selling a property, the owner, property manager and/or sales agent must comply with tenancy and privacy legislation.  This means you must have written consent from a tenant to show their possessions in any photos taken and used to advertise the property.

Remembering that it is the tenant’s home, and while your reasons for taking photos may be valid, you must respect their privacy and quiet enjoyment while they are living in the property, this also includes photos during routine inspections.  Your current property manager should be adhering to these laws and only photographing areas of concerns, repairs needed.

Avoiding and resolving tenancy issues always come back down to good communication.  Discussing the steps you have in place to ensure their privacy and addressing any concerns the tenant may have prior to organizing a photo shoot would make for a much smoother process for everybody involved.
